Protocol for User Registration of
DOE/EM-Approved Fissile or Type B Radioactive Material Packagings
DOE Order 460.1B Packaging and Transportation Safety, Section 4.a.(2)(c)2b includes a requirement for users of fissile or Type B radioactive material packagings to Register in writing with the Assistant Secretary for Environmental Management prior to using a DOE Certificate of Compliance. Below is the protocol for registration of users of DOE-approved fissile or Type B radioactive material packagings developed based on 10 CFR 71.17(c)(3) and 49 CFR 173.471(a).
Each person who offers for transportation quantities of radioactive materials exceeding A1 or A2 or fissile quantity of radioactive materials in a package certified by DOE shall register in writing with the Assistant Secretary for Environmental Management prior to using the certificate. Before each person's first use of a DOE-approved package, the person shall submit a registration in writing to:

10 CFR 71.17 General license: NRC-approved package. Paragraph (c)(3) states:
This general license applies only to a licensee who - before the licensee's first use of the package, submits in writing to ATTN: Document Control Desk, Director, Spent Fuel Project Office, Office of Nuclear Material Safety and Safeguards, ...the licensee's name and license number and the package identification number specified in the package approval.
49 CFR 173.471 Requirements for U. S. Nuclear Regulatory Commission approved packages. Paragraph (a) states:
The offeror shall be registered with the USNRC as a party to the packaging approval, and make the shipment in compliance with the terms of the packaging approval; ...
The DOE process for registration of users for DOE-approved packages tracks with the regulatory requirements of the regulations stated above, but DOE contractors are required to register with the DOE Packaging Certification Program (EM-63) prior to first use of a DOE approved packages.
